Terms of Use – Bitcoin Depot ATMs Australia
Effective Date: 17th January, 2025
1. About the Website
These Terms govern your use of the PIPezi Services (defined below), being digital currency exchange services provided through BTMs by PIPezi trading as Bitcoin Depot Aus.
By accessing, using, attempting to use or clicking “I agree” on any PIPezi Services, you agree that you have read, understood and accepted all the terms and conditions set out in these Terms as well as our Privacy Policy at https://pipezi.com/privacy-policy.
PIPezi provides access to the Bitcoin Depot Teller Machine services under its trading as name Bitcoin Depot Aus.
There is a substantial risk of economic losses when purchasing, selling, holding or investing in Digital Assets (defined below).
By using PIPezi designated services, you acknowledge and agree that:
- You are aware of the risks associated with transacting Digital Assets;
- You assume all risks related to the use of the PIPezi Services; and
- PIPezi shall not be liable for any such risks or adverse outcomes.
- If you do not agree to these terms, do not access or use PIPezi Services.
- By using our services, you agree to these Terms of Use as outlined forthwith.
- If you do not agree, please refrain from using our services.
1. Key Definitions
- PIPezi: means PIPezi Pty Ltd (ABN: 28 647 321 506). PIPezi is utilising Bitcoin Depot Operating LLC services under contract, providing digital currency exchange services. PIPezi is registered to provide digital currency exchange services in accordance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). PIPezi is an AUSTRAC registered digital exchange provider with registration number: DCE 100754286-001
- PIPezi Services means the service of exchanging digital currency assets for fiat currency through BTMs – Bitcoin Automatic Teller Machines.
- Bitcoin Depot: means the United States business Bitcoin Depot Operating LLC who are the contracted provider of the Bitcoin BTMS in Australia and additional services associated with facilitating the supply of Bitcoin to PIPezi.
- Digital Assets: means encrypted or digital tokens or cryptocurrencies with a certain value that is based on distributed ledger technology and cryptography technologies. Digital Assets available for purchase include only Bitcoin.
- BTMs: means Bitcoin BTMS (Automatic Teller Machines) that allow you to buy Digital Assets using Fiat Currency.
- Fiat Currency: means Australian Dollars (AUD).
- Account: means a virtual user account created to access PIPezi Pty Ltd services and record personal details and transaction history.
- Government-Issued ID: means an Accepted forms of government-issued ID include a physical (not scanned); Driver’s Licence or permit from Australia or overseas (including a digital Driver’s Licence), an Australian passport, a government proof of age card issued in Australia, a foreign passport issued by a foreign government or the United Nations international travel documents issued by a foreign government or the United Nations, and a national identity card issued by a foreign government or the United Nations. Passports must not be expired. Acceptance of ID documents is dependent on verification by third party service providers.
2. General Conditions
- Supplementary Terms: The Privacy Policy and all other agreements entered separately between you and PIPezi are deemed supplementary terms that are an integral part of these terms and shall have the same legal effect:
- Acceptance of Terms: By accessing or using our services, you agree to these Terms and any supplementary terms, such as our Privacy Policy.
- Changes to Terms: PIPezi reserves the right to change these Terms at its discretion at any time. PIPezi will notify such changes by updating the terms displayed on its website or via PIPezi Services. Changes take effect when published on our website or displayed at our BTMS. If you continue to use the services after updates, you agree to the new Terms. If you do not agree to any changes to these Terms, you must stop using PIPezi Services immediately.
3. Registering for and using an Account
- Users must register and open an Account in accordance with the provisions of these Terms before being able to use PIPezi Services to exchange Fiat Currency for Digital Assets.
3.1 Eligibility
- To register for an Account in Australia and use the services provided at the Bitcoin Depot BTMS and online, you must:
- Be at least 18 years old.
- Use the services only for yourself and not on behalf of others.
- Not have a previously suspended or terminated account.
- Have a valid and accepted form of identification.
- Be opening an Account for yourself and not on or behalf of someone else and will only use PIPezi Services for yourself and not on or behalf of someone else.
- Ensure your use of PIPezi Services will not violate any laws or regulations applicable to you, including but not limited to regulations on anti-money laundering, anti-corruption, and counter-terrorist financing.
3.2 Registration Requirements
- To register an Account before using our services, you must provide:
- Government-issued ID for verification.
- A mobile phone number for SMS verification.
You must ensure all information is accurate and up to date. PIPezi may reject applications if information is incomplete or inaccurate. To complete your application, you must accept these Terms, the Privacy Policy, and other Supplementary Terms. PIPezi may refuse, in its sole and absolute discretion, to open an Account for you.
You agree to provide complete and accurate information when opening an Account and agree to update PIPezi by emailing [email protected] if any information you provide changes
3.3 User Identity Verification
By applying for an Account, you agree to provide a Government-Issued ID for identity verification.
We may require additional personal information to verify your identity, including your name, email address, contact information, phone number, date of birth, address and other information.
You agree to allow us to keep a record of your personal information during the period for which your Account is active and within seven (7) years after your Account is closed.
You also authorise us to conduct necessary investigations directly or through a third party to verify your identity or protect you and/or us from financial crimes, such as fraud.
3.4 Acceptance
When you access or use any PIPezi designated services (BTM kiosks, website, or app), you agree to follow these rules:
- Acceptance: By using our services, you confirm that you are 18 or older and capable of entering into a legal contract.
- Honesty: Provide accurate information and do not misrepresent yourself.
3.5 Account Security
You shall agree to treat your access credentials (such as one-time SMS passwords) as confidential information and not to disclose such information to any third party. You also agree to be solely responsible for taking the necessary security measures to protect your Account and personal information.
3.6 Account Usage Requirements
Accounts can only be used by the account registrant. Your Account may be suspended or canceled by PIPezi or by third parties. PIPezi or Bitcoin Depot = assumes no liability for any loss or damage arising from the use of your Account by you or any third party with or without your authorisation.
The PIPezi services are provided through the use of BTMs provided by hardware suppliers such as Bitcoin Depot Operating LLC. By using the PIPEzi Services, you acknowledge that the PIPezi Services are provided by PIPezi and not by the suppliers of the hardware, such as Bitcoin Depot Operating LLC and that such hardware suppliers have no obligation to you in respect of the PIPezi Services.
4. Using Bitcoin Depot BTMs
4.1 Getting Started
Before using a Bitcoin Depot BTM, you will need:
- A QR code for your Digital Asset wallet address.
- A mobile phone for verification.
- The Fiat Currency you intend to exchange.
- Upon completion of the registration and identity verification for your Account, you may use Bitcoin Depot BTMs to exchange Fiat Currency for Digital Assets in accordance with the provisions of these Terms. You will need to find a Bitcoin Depot BTM and sign in using your Account. You can search for locations at the following address: www.bitcoindepot.com.au
4.2 Transactions
Buying Digital Assets: Bitcoin
- You can only purchase Bitcoin at the BTMs. No other cryptocurrency is offered for purchase.
- There may be a minimum amount of fiat you can exchange for cryptocurrency. The first note you enter must be equal or higher than this minimum amount. After that, the rest of the notes can be either $5, $10, $20, $50 or $100 (provided they are for the same transaction).
- Insert cash at a kiosk or follow online instructions.
- Provide your wallet address.
- You’ll receive your Bitcoin after payment confirmation, though timing may vary due to network conditions.
- All sales are final and cannot be reversed or cancelled once the transaction is confirmed.
- • The Service Fee is a flat fee per transaction, and this is shown before you confirm the transaction. The Service fee is $5 for any transaction value to be done.
- • Variable Spread fees are also charged and included in the displayed Digital Asset price and may fluctuate with the market. The standard variable spread fee being charged is between 17.3% and 50% of the total transaction amount. This fee may vary depending on location and promotional activities being carried out during a marketing campaign period.
- • PIPezi reserves the right to change fees at any time without notice.

• There are minimum and maximum transaction limits, which will be displayed on each BTM.
> The minimum transaction is AUD$20.00
> The maximum transaction is AUD$20,000 - For accumulative or one-time purchases of more than AUD$10,000 further identification requirements and checks will be required to be carried out on the account holder.
- • PIPezi may impose or change transaction limits at any time.
- • Once a transaction is confirmed, it cannot be reversed.
- • If an issue occurs before a transaction is confirmed, contact support for help.

Completed transactions and transactions to a wallet that you do not control are not eligible for a refund.
> Once a transaction has been initiated and funds have been paid into the BTM, you will not be able to cancel the transaction. It is important that you review your order before finalizing it. - You acknowledge that in the event of requesting a refund that you must notify Bitcoin Depot Australia’s Customer Service Department via email to [email protected] within one to three days of your purchase. You will be required to provide accurate and complete information, as well as any receipts for transactions made.

As per the initial registration requirements we will need your basic information to verify your identity, such as your name, date of birth, and contact details such as your email and mobile phone number. You will be asked to provide a form of government recognized identification with a photo of yourself such as a passport, driver’s license, over 18 identification card and or other. Such identification must be an original and not a copy or digital image thereof.
Please be informed that we may also request additional information from you in the future once you have established an account. This could include information about the source of funds you are using to purchase digital assets with and other details about the nature of your transactions. PIPezi may suspend services if verification requirements are not met.
You must not:
- Use our services including any wallet you setup for any illegal activities, including money laundering, scams, any form of financial crime, tax evasion, or for supporting the funding of terrorism.
- • Use fake or stolen identification.
- • Use another person’s identification even with their permission.
- • Use another person’s wallet or wallet that you do not have sole control thereof.
- Tamper with our BTMs.
- • Attempt to disable our services in any way.
We may suspend or terminate your account if we suspect any of the above actions.
- You are responsible for safeguarding your:
- • Wallet details and QR codes
- • Access credentials (e.g., SMS verification codes).
- PIPezi is not responsible for losses due to unauthorized access or incorrect wallet details.
- • Bitcoin is highly volatile. Prices can change dramatically in a short period. You may lose money due to market movements. We do not provide financial or investment advice. It’s your responsibility to understand the risks before using our services.
- • We do not provide financial advice. Make sure you understand the risks before using our services.
- • You agree to take all risks incurred in purchasing Digital Assets with Fiat Currency. PIPezi is not responsible for any loss incurred in trading. You may lose all your funds by purchasing Digital Assets. PIPezi may not be able to provide the liquidity of the exchange. Your exchange may be subject to high slippage. You bear all the loss from using our services.
- • Beware of scams. Never send Digital Assets to someone else’s wallet if asked by a third party.
- • PIPezi or Bitcoin Depot is not responsible for losses due to fraud or scams.
- Once confirmed, Digital Asset transactions are irreversible. Double-check wallet addresses before completing any transaction.

• Personal Wallets Only:

o We are not responsible if Bitcoin is sent to the wrong address or to a third party.
o Transactions cannot be reversed once completed. -
• Wallet Compatibility:
Make sure the wallet you provide is compatible with the cryptocurrency you are purchasing.

In summary, you understand that it is your responsibility to:
- • Keep your account login details private. If someone else uses your account, you are responsible for their actions.
- • Report Issues. Contact us immediately if your account is compromised or if you suspect unauthorized use.

It is your responsibility to determine what, if any, taxes apply to the purchases you complete via our BTMS, and it is your responsibility to report and remit the correct tax to the appropriate tax authority. You agree that PIPezi is not responsible for determining whether taxes apply to your trades or for collecting, reporting, withholding or remitting any taxes arising from any trades.
In Summary:
- • You are responsible for determining and paying any applicable taxes on Digital Asset transactions
- • PIPezi does not provide tax advice.
- • You agree to consult a tax professional if and as needed.
- As part of you agreeing to this service you agree to and understand that PIPezi may suspend or terminate your account or access to services if we suspect:
- • You violate these Terms or any applicable law.
- • Your account is linked to fraudulent or suspicious activity.
- • You provide false or misleading information.
- You agree that PIPezi shall have the right to immediately suspend your Account, freeze or lock the Digital Assets or Fiat Currency in all such accounts, and suspend your access to BTMs without notice and in our sole discretion for any reason, including if PIPezi suspects any such accounts to be in violation of these Terms, our Privacy Policy, or any applicable laws and regulations.
- You agree that PIPezi shall not be liable to you for any permanent or temporary modification of your Account or suspension or termination of your access to all or any portion of PIPezi Services.
- PIPezi shall reserve the right to keep and use the transaction data or other information related to such Accounts.
- Notwithstanding anything contained in these Terms, PIPezi reserves the right, without notice and at our sole discretion, to terminate your right to access or use the designated services provided at any time and for any reason, and you acknowledge and agree that we shall have no liability or obligation to you in such event and that you will not be entitled to a refund of any amounts that you have already paid to us, to the fullest extent permitted by applicable law.
- If your Account is terminated, the account and transactional information that meet data retention standards will be securely stored for seven (7) years. In addition, if a transaction is unfinished during the account termination process, PIPezi shall have the right to notify your counterparty of the situation at that time.

• Personal Wallets Only:
o Only send Bitcoin to wallets you own.
o We are not responsible if Bitcoin is sent to the wrong address or to a third party.
o Transactions cannot be reversed once completed. -
• Wallet Compatibility:
Make sure the wallet you provide is compatible with the cryptocurrency you are purchasing.
- Your Choice: You can close your account by contacting us at [email protected] or [email protected].
- Our Rights: We may suspend or close your account if you breach these Terms or Australian laws.
- Data Retention: We may retain your account information for legal or regulatory purposes.
- • If you have a complaint, contact us at [email protected]. We will do our best to resolve the issue quickly.
- • We recommend trying to settle disputes through communication before seeking legal action.
- • Any unresolved disputes will be governed by Australian law.
- • Claims must be brought within 1 year of the issue arising, or they may be considered invalid.
- PIPezi provides its services “as is” and “as available” without any warranties, express or implied. We do not guarantee that services will be uninterrupted or error-free.
- To the maximum extent permitted by law, any products, services or other items provided by or on behalf of PIPezi are offered on an “as is” and “as available” basis, and PIPezi expressly disclaims, and you waive, any and all other warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, title or non-infringement or warranties arising from or in the course of performance, dealing or usage in trade.
- Without limiting the foregoing, PIPezi does not represent or warrant that PIPezi products or services are accurate, complete, reliable, current, error-free, or free of viruses or other harmful components.
- PIPezi does not guarantee that any purchase will be executed, accepted or recorded. Except for the express statements set forth in these Terms, you hereby acknowledge and agree that you have not relied upon any other statement or agreement, whether written or oral, with respect to your use and access to PIPezi Services.
- Without limiting the foregoing, you hereby understand and agree that PIPezi will not be liable for any losses or damages arising out of or relating to:
- 1. Any inaccuracy, defect or omission of digital assets price data;
- 2. Any error or delay in the transmission of such data;
- 3. Interruption in any such data;
- 4. Regular or unscheduled maintenance carried out by Bitcoin Depot and service interruption and change resulting from such maintenance;
- 5. Any damages incurred by other Users’ actions, omissions or violation of these terms; and Any damage caused by illegal actions of other third parties or actions without authorisation from PIPezi.
- To the maximum extent permitted by law, PIPezi (and each of our officers, directors, members, employees, agents and affiliates) is not liable to the User in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by the User of an indirect or consequential nature including any economic loss or other loss of turnover, profits, business or goodwill.
- Notwithstanding the foregoing, in no event will the liability of the PIPezi (and each of our officers, directors, members, employees, agents and affiliates) under or in connection with these Terms, whether arising in contract, tort, negligence, breach of statutory duty or otherwise must not exceed the fees paid by the User to PIPezi for the use of PIPezi Services under these Terms in the 12 months prior to the act that gave rise to the liability, in each case, whether or not PIPezi has been advised of the possibility of such damages.
In summary the fullest extent permitted by law:
- PIPezi is not responsible for losses due to market fluctuations, incorrect wallet addresses, or technical errors beyond our control.
- Our maximum liability is limited to the transaction fees you paid in the 12 months before the issue.
- You agree to defend, indemnify and hold harmless PIPezi (and each of our officers, directors, members, employees, agents and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable legal fees, arising out or relating to:
- Your use of, or conduct in connection with using PIPezi designated services;
- Any feedback you provide;
- Your violation of these Terms;
- Your violation of any rights of any other person or entity; or
- Fraudulent or unauthorized use of your account or our services.
- If you are obligated to indemnify us, we will have the right, in our sole discretion, to control any action or proceeding and determine whether we wish to settle it and, if so, on what terms.
- PIPezi complies with Australian AML/CTF laws.
- Certain transactions may be reported to AUSTRAC as required by law.
- You are responsible for complying with all applicable laws and regulations.

In the event of an error, whether via our services, in processing your purchase, or otherwise, we reserve the right to correct such error and revise your purchase transaction accordingly (including charging the correct price) or to cancel the purchase and refund any amount received.

You understand that in rare instances it may take weeks for us to reach a resolution or longer due to circumstances which are out of our control, such as delays from related third-parties (such as cash collections companies or ATM manufacturers).

- You understand and agree that PIPezi is not your broker, intermediary, agent, or advisor and has no fiduciary relationship or obligation to you in connection with any exchanges or other decisions or activities effected by you using PIPezi Services.
- PIPezi is not obligated to provide you with training, education, advice, or any other services in relation to Digital Assets, including how to use store, transfer, or transact any Digital Assets you purchase.
- No communication or information provided to you by PIPezi is intended as or shall be considered or construed as investment advice, financial advice, trading advice, or any other sort of advice. PIPezi does not recommend that any Digital Asset should be exchanged or held by you.
- You are solely responsible for determining whether any investment, investment strategy or related transaction is appropriate for you according to your personal investment objectives, financial circumstances and risk tolerance, and you shall be solely responsible for any loss or liability therefrom. You should consult legal or tax professionals regarding your specific situation.
- Opening an Account requires the submission of certain personally identifiable information. Please review our Privacy Policy at www.pipezi.com/privacy-policy for a summary of our guidelines regarding the collection and use of personally identifiable information.
- In summary, please note the following key points:
- Our Commitment: We protect your personal information in line with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs).
- Your Responsibility: You agree not to share others’ personal information without their permission.
- Marketing: We may send you SMS messages or emails if you’ve given us permission. You can opt-out at any time
- PIPezi may update these Terms at any time. Changes are effective upon publication. Continued use of our services indicates acceptance of the updated Terms.

- Do not participate in any illegal activities that could cause your account to be closed.
